If you are stopped for a DUI, the actions a police officer takes depend on several factors, including how you act at the scene. In most cases, the officer will ask you to take the DUI tests and a breathalyzer test.


You could be arrested if you have a blood alcohol concentration (BAC) of 0.08 or higher or if you have any Schedule 1 illegal substances in your blood. And, if your BAC is 0.15 or higher, the police could charge you with an aggravated DUI, in which case, the punishment is more severe.


One of the problems with the breathalyzer test is that it could give an incorrect reading, whether because the machine is defective, because you are taking a legally prescribed drug or because you ate something that triggers it.
